Terms of Service

These Terms of Service govern your use of the Track It Sis website at track-it-sis.vercel.app, operated by Chat Chew and Do Empowerment Women Group (CCDEW), a Mississippi nonprofit. By using the Service, you agree to these Terms.

Medical Disclaimer

Track It Sis is an educational self-tracking tool. It is not medical advice, diagnosis, or treatment. Information provided is for general informational and educational purposes only. Always consult a qualified healthcare provider regarding any medical condition, symptom, or treatment. Never disregard professional medical advice or delay seeking it because of something you read on the Service. If you think you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to agree to these Terms.

User Accounts and Accuracy

You agree to provide accurate information when registering. You are responsible for all activity that occurs under your registration on your device.

Acceptable Use

You agree not to use the Service to violate any law, infringe on the rights of others, transmit harmful code, attempt to gain unauthorized access, interfere with the Service, or use the Service for any commercial purpose without written permission from CCDEW.

Intellectual Property

All content on the Service, including the Track It Sis name, Beyond the Hairline name, logos, text, graphics, design, and code, is owned by CCDEW or its licensors and protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works without written permission.

User Content

Any information you input into the journal remains your property. Because this content is stored only on your device and not transmitted to CCDEW, CCDEW has no access to, control over, or responsibility for your journal entries.

No Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. CCDEW does not warrant that the Service will be error-free or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, CCDEW, its officers, directors, volunteers, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of the Service. CCDEW's total aggregate liability shall not exceed one hundred US dollars ($100).

Indemnification

You agree to indemnify, defend, and hold harmless CCDEW, its officers, directors, volunteers, and affiliates from any claims, damages, losses, liabilities, and expenses, including reasonable attorney fees, arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

CCDEW reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

Third-Party Links and Services

The Service may contain links to third-party websites or reference third-party services. CCDEW does not endorse or assume responsibility for any third-party content, products, or services. Your use of third-party websites is at your own risk.

Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered in Mississippi in accordance with the rules of the American Arbitration Association. You waive the right to a jury trial and the right to participate in any class action.

Governing Law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict of laws principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Mississippi.

Force Majeure

CCDEW shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government action, power failure, or internet or telecommunications failure.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions shall remain in full force and effect.

Assignment

You may not assign or transfer these Terms or your rights under them without prior written consent from CCDEW. CCDEW may assign these Terms at any time without notice.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CCDEW regarding the Service and supersede any prior agreements.

Changes to These Terms

CCDEW may modify these Terms at any time. Changes are effective upon posting with an updated date. Continued use of the Service after changes means you accept the revised Terms.
